The Game-U website www.Game-U.com and the classes and other services available there (collectively, the “Service”) are operated by Game-U, LLC, located at 160 Main St., Flemington NJ 08822 (“Game-U”). We take the private nature of your Personal Information very seriously and this Privacy Policy describes how we treat the information we collect from people who visit or use the Service, including the children who are enrolled in our various programs (“Enrollee(s)”). Please read this notice carefully.
BY VISITING THE SERVICE, YOU EXPRESSLY CONSENT TO THE PROCESSING OF YOUR AND THE ENROLLEE’S PERSONAL INFORMATION ACCORDING TO THIS PRIVACY POLICYIF YOU DO NOT AGREE WITH OUR POLICIES AND PRACTICES, YOUR CHOICE IS TO NOT USE THE SERVICE. YOUR PERSONAL INFORMATION MAY BE PROCESSED IN THE COUNTRY WHERE IT WAS COLLECTED AS WELL AS OTHER COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING OF PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY. BY UPLOADING PERSONAL INFORMATION TO THE SERVICE, YOU WARRANT THAT YOU HAVE THE RIGHT TO TRANSFER SUCH INFORMATION OUTSIDE YOUR COUNTRY AND INTO THE UNITED STATES.
Children’s Privacy
The Service is for Enrollees under 18 years of age who use the Service under the express guidance and supervision of a parent or guardian who has accepted this Privacy Policy on the child’s behalf. By executing the Parental COPPA Notice and creating an account for your child you are consenting to the collection, use and disclosure of your child’s Personal Information as provided herein. Enrollees are not permitted to use the Services without your direct consent and guidance. We require that you assist your Enrollee in using the Services so that you may monitor the Personal Information that they are disclosing.
Personal Information we Collect
In order to provide the Services, we will collect some information that identifies you and your associated Enrollees (“Personal Information”). When you create an account on the Service or sign up your child for classes, you may voluntarily give us certain information about yourself or your child. This can include name, username, email address, city, state, demographic information (such as birthdate, age, sex, etc.) and any other information you provide us. We also collect records and copies of your correspondence (including email addresses), if you contact us. If you’re visiting the Service on your mobile device, you may also choose to provide us with location data. We keep all Personal Information strictly confidential and only use it in order to provide the Services, at your direction, or as otherwise set out in this Privacy Policy. Information We Collect from Children
We do not collect Personal Information from any child under 13 years of age without the verified parental consent of their parent or guardian. During the registration process, you will be asked to input Personal Information about the Enrollee such as name and email address and may be asked additional profile questions regarding their use of the Services. If you provide any Personal Information about a child under 13 years of age to the Service, you expressly represent that you are the parent or guardian of the child and have the full right and authority to upload the information. If you believe we might have any information collected from a child under 13 years of age in violation of this Privacy Policy, please contact us at ahewitt@gameucorp.com.
When using the Services, Enrollees may have the ability to upload certain content to the publicly accessible classroom message board, including Personal Information, images or location information, that may be used to identify your child. We prohibit your child from uploading such information to the classroom message board, however, we may not monitor the message boards to verify that Enrollees comply with this requirement. The amount and type of Personal Information that Game-U collects from Enrollees depends on the nature of their interaction with the Services. Children are required to refrain from posting Personal Information and if they abide by this requirement, Game-U will not collect any Personal Information directly from your child. If you believe your child may have submitted Personal Information to the Services without your permission or consent, please contact us via email at ahewitt@gameucorp.com and we will delete the information.
Website Access Information and Use of Cookies
Website Access Information
Like most website operators, Game-U collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request when visitors use the Service. Game-U’s purpose in collecting non-personally-identifying information is to better understand how Game-U’s visitors use or visit the Service. From time to time, Game-U may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its Service. Game-U also collects potentially personally-identifying information like Internet Protocol (IP) addresses and may collect statistics about the behavior of visitors to the Service. For instance, Game-U may monitor the Service to help identify spam. We also may use these technologies to collect information about your online activities over time and across third-party Service or other online services (behavioral tracking).
In addition to log data, we may also collect information about the device you’re using to access the Service, including the type of device, the operating system, device settings, device identifiers and crash data. Whether we collect some or all of this information often depends on what type of device you’re using and its settings. We do not collect Personal Information automatically, but we may tie this information to Personal Information about you that we collect from other sources or you provide to us.
Cookies and Web Beacons
Like many Services, the Service may use “cookies” to collect information. A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Game-U may use cookies to help identify and track visitors, their usage of the Service, and their website access preferences. Website visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Service, with the drawback that certain features of the Service may not function properly without the aid of cookies. Certain features of our Service may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Service. Pages of our Service may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
Financial Data
Game-U uses iClass, Square and other secure payment providers, to process your payments if you purchase items or classes on the Service. When purchasing through our Services, Game-U stores your payment information subject to the privacy policy and terms of use of iClass, Square and other secure payment providers iClass, Square and other secure payment providers. We recommend you review these policies before uploading any credit card information. Game-U does not have access to your credit card information and does not store this information on our servers.
Use and Disclosure of Personal Information
Game-U will use the Personal Information that you or the Enrollee submit to us to provide you full access and functionality of the Services. We will never sell your Personal Information. Accordingly, Personal Information may be used for the following purposes: (i) to provide and improve our services, features and content; (ii) to administer your use of our services and accounts; (iii) to enable users to enjoy and easily navigate the Services; (iv) to better understand your needs and interests; (v) to fulfill requests you may make; (vi) to personalize your experience; (vii) to provide you with announcements, notifications related to your use of the Services and other communications such as electronic newsletters, promotional e-mails or similar messaging; (viii) to provide service announcements; (ix) to protect against users seeking to hack into the Services; (x) to assess the level of general interest in the Services and specific information included in the Services; (xi) for any other purpose with your consent. If we ever send you information by e-mail concerning new products, services or information, we will provide you with a link to unsubscribe to all future marketing communications from Game-U.
Except as provided elsewhere in this policy Game-U will not disclose Enrollee Personal Information to third parties outside of Game-U and its service providers, affiliates, vendors and business partners unless Game-U has the good faith belief that disclosure is reasonably necessary to:
- cooperate with law enforcement authorities or comply with legal process served on Game-U or the Services;
- protect the property and rights of Game-U, its affiliates or a third party;
- protect the safety of the public or any person;
- prevent or stop any activity we may consider to be, or to pose a risk of being, illegal, unethical, inappropriate or legally actionable (including by providing information about an Enrollee to law enforcement if we believe that child is at risk or poses a risk to others);
- complete, as permitted by law, a business sale, asset transfer, merger, acquisition or reorganization; or
- fix or debug problems with the Website or App servers, software or service.
If Game-U discloses an Enrollee’s Personal Information for one of these purposes, we will do so only to the extent necessary.
If your child posts their Personal Information to a publicly accessible message board the information will be disclosed to the other members of the classroom. All users of Game-U have agreed to not disclose Personal Information learned from a classroom message board to any third parties, however, Game-U is under no obligation to take any action and faces no liability in the event its users violate this obligation.
International Users
For users outside the United States, please note that any personally-identifiable information you or the Enrollee enters into the Services will be transferred out of your country and into the United States. You consent to such transfer through your child’s use of the Services. You also warrant that you have the right to transfer such information outside your country and into the United States.

In order to provide the Services, we may engage contractors and other service providers (“Service Providers”) to provide to us certain services. These Service Providers handle and process your personal information in accordance with our explicit instructions and this Privacy Policy. These Service Providers may include:

If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.

You have the right to correct factual errors in such information, request to have information deleted or request that we no longer collect or maintain such information. Please be aware, however, that Game-U may not be able to delete information that has been disclosed by Game-U users to other third parties.
Please be sure to include your email address and a telephone number where we can reach you in any request to access or delete information. To protect you and your child’s privacy and security, we will take reasonable steps to verify your identity before granting you access to the Personal Information that we collect and maintain about you or your child.
We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
SMS Privacy Policy
GAMEU is committed to protecting your privacy. This Privacy Policy (the “Policy”) governs how we treat the Personal Information that we collect and receive from you in connection with your use of the SMS Service (“Service”), which we make available to you through a third-party service provider. This Policy is incorporated into the Terms of Service.
By using the Service, you agree to the terms of this Policy. GAMEU reserves the right, in its sole discretion, to modify or change this Policy at any time with or without prior notice to you. The date of the last update will be posted at the top of this Policy for your convenience. This Policy, and any changes, are effective as soon as posted. Your continued use of the Service following the posting of any changes to the Policy constitutes your full acceptance of those changes.
“Personal Information” is information that individually identifies you, such as your mobile phone number or user/screen name, as well as the any Personal Information that you choose to include in messages you send through the Service.
Opting in
A mobile user might opt-in by:

- Signing up for classes at GameU
Opting out
GameU’s third-party service provider gives you the ability to opt out of the Service for any reason. You can opt out by texting “STOP”.
We reserve the right to send you certain communications relating to the Service, such as announcements and administrative messages, without allowing you to opt out of receiving them.
Your California Privacy Rights
California Civil Code Section § 1798.83 permits users of our Service that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Family Educational Rights and Privacy Act
While Game-U classes are not accredited or associated with any educational institutions or any funding programs by the Department of Education and therefore the Federal Educational Rights and Privacy Act is not directly applicable to us, we respect the rights afforded to parents by that law. This means that under no circumstances will we disclose information about your child’s performance in a course to any individual other than a parent or guardian. If you wish that we send our performance records to an educational institution, please contact us via the information below and we will do our best to accommodate your request.
Security
Game-U is concerned with safeguarding your child’s information. We employ a variety of industry-standard measures designed to protect your child’s information from unauthorized access. The servers in which we store personally identifiable information are kept in a secure environment, and only employees who need the information to perform a specific job are granted access to personally identifiable information.
Privacy Policy Changes
We reserve the right to modify this Privacy Policy from time to time without notice. Please review this Privacy Policy each time your child uses the Services so that you will be apprised of any changes. Your child’s continued use of the Website and App subsequent to any posted changes to this Policy means you accept those changes. In all cases, use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected. We will provide notice to you if these changes are material and, where required by applicable law, we will obtain your consent.
